Public procurements outside the law
Participants of public procurements may lose their right to appeal against results of tenders. Beginning of this process has been initiated by the Commercial Court of Kyiv, which has refused to sustain a claim on the ground the Decree of the Cabinet of Ministers of Ukraine On Procedure of Public Procurements is illegal. In case, other courts will use such a precedent in practice, public procurements may become the fiction.

The amount of debts under enforcement proceeding, which are performed by Departments of State Enforcement Service of Ministry for Justice of Ukraine in this year has turned UAH 51 billiards what is 5% of country’s GDP. In this year, officers of justice could collect for creditors merely UAH 21 billiards. DSE’s activity has been acknowledged the worst since 2001. Government’s Resolution No.549 dated 03 June 2009 recently has been proclaimed. The Resolution stipulates moratorium on controlling checks of local councils and officials. In accordance with this document Cabinet of Ministers prohibits to Ministry of Internal Affairs, Ministry for Environment, Main Department of State Service and other bodies to provide controlling checks till 31st December 2010. Thereby, Cabinet of Ministers created good conditions for corruption in local councils.
